What Is The CR1 Visa Category?

Introduction to CR1 Visa Category

Many people know that marrying a U.S. citizen makes them eligible for a spousal visa to immigrate to the U.S. Still, there is often confusion between the two immigrant visa categories for spouses: IR-1 and CR-1.  So what is the difference?  Well, the “C” is a very important clue because it stands for “conditional.”

Understanding the Difference Between CR1 and IR1 Visas

The process to start both visas is the same.  The U.S. citizen files an I-130 petition with USCIS for their spouse. Then, after the petition is approved, the spouse applies for an immigrant visa at the designated US Embassy or Consulate to join the spouse in the US.  However, if the marriage is less than two years old at the time of application for the visa, the spouse receives a CR-1 visa valid for 2 years and allows a two-year period of conditional permanent resident status in the US.  Suppose the marriage is over two years long at the time of visa application. There is no conditional status in that case, and an IR-1 visa is issued valid for 10 years. It has no conditional status that leads to immediate permanent residency status.  

Requirements and Conditions for Conditional Resident Status

The reason for the shorter visa validity and conditional resident status for the CR-1 is to fight marriage fraud.  US immigration law specifies that within 90 days of the couple’s two-year wedding anniversary, the couple must undergo a follow-up review by USCIS staff in the US.  This ensures that the couple enters a legitimate marital relationship that entitles the immigrant spouse to legal permanent residency (LPR) status and remains in the US. 

The couple files USCIS form I-571 and provides additional evidence of a legitimate marital relationship, like photos, financial documents, and other proof of a life together in the US.  An in-person interview with a USCIS official may also be required.  After a successful review, the conditional status is removed, and the immigrant spouse receives a full 10-year Permanent Residency Card (green card)
